Hi Eve,
i’m in a similar situation. My husband (other EU citizen) and I (Brit) have bought in the GARD. I have currently a German residency card allowing me to stay for up to 90 day.
I read from French Services web-site that I have to apply for a titre de sĂ©jour. They point me to the Étrangers en France form but i can’t proceed as in the drop-down list of nationalities there are only EU states.
I then approached the Gard State-services website and it implies i have to apply in writing and like you receive a form https://www.gard.gouv.fr/index.php/contenu/telechargement/38987/268598/file/1-Formulaire%20Titre%20de%20séjour.pdf 

I filled out the form with difficulty as it asked for a Visa number i don’t have. Then i got totally deflated by a statement on page three “pour l’accĂšs Ă  une carte de rĂ©sident vous devez avoir un justificatif de niveau A2 en français”.
I seem to be going round in circles 
tomorrow i have a booked meeting with Local French Services office but i’m not sure how much they will be able to help.

Using the regular online EU carte de sĂ©jour application form on ANEF/France Titres, why not select the nationality of your EU husband from the drop down list. After that, very clearly explain in the ‘free form’ field at the end of the online form exactly why you’ve been ‘forced’ to do that, and then specifically draw their attention to your UK passport, which you’ve presumably uploaded as part of the normal EU CdS application process. There’s presumably some IT programming glitch involved, producing the list of EU countries only. It’s a bit disappointing they haven’t resolved this problem to date.

Good timing as I was just thinking to pop back in for an interim update here.
I have not got my CDS yet so I can only update you on where I’m up to date.
I did contact the ANEF via submission form and had some emails back and forth - they were hugely unhelpful and just kept telling me I hadn’t taken enough screenshots :laughing:
I then became concerned that I would miss the 90 days to submit.

@George1 was very helpful with some suggestions and I followed what he has mentioned in his comment below.
I used my husband’s nationality, one of the last boxes before submission is ‘any other information’ or some such, and I used it to explain that there was no option to use my own nationality in this box, only EU. I can’t remember if there was an option to attach a file at this stage, but if there is I would suggest you attach a screenshot too.
The update is that a few weeks later I got an email stating that I had used the wrong nationality - obviously (I’m unsure if they even read my comment to be honest!) - and that I needed to send them my translated birth certificate to prove my nationality, which I did promptly.
I didn’t hear anymore until I suddenly received an email with a time and date for biometrics, which I attended. The lady was very kind and they didn’t ask me any questions at the appointment (thank goodness, my French is at a low A2 level and not sure I am ready for bureaucracy!).
I subsequently got an email requesting more information on my husband’s self employed status, and to send through rent receipts, but nothing relating to the nationality.

So as you can see - not resolved yet, as I have not received the CDS, but the fact that they have not asked me anymore questions about my nationality gives me hope that the nationality question itself is resolved. The main concern I have with this approach is that the confirmation receipt showing I have submitted my CDS shows my nationality as ‘Lettone’ (Latvian). I am not 100% clear on this but I believe it’s not necessarily advisable to travel beyond the 90 days and if you don’t yet have your CDS, but that if you do you should use this receipt to prove you have submitted it. I wouldn’t chance travelling with this receipt showing an incorrect nationality so I do feel a little stuck until it’s resolved! To give you a timeline, I first submitted on the 8th Feb, so I’m about six weeks into the process now.

Up all night and my latest research shows that spouses of EU can’t use the online form. I found a link to a Q&A sheet

See Point 39, we can’t use the online form and must go to the prefecture

So now the next issue. I downloaded the form to fill in from the Gard prefecture 
it was asking some strange things about level of French language. So I looked for similar forms on other Prefectures and found the one for Department de Nord. So i think the department for Gard uses a “catch-all” form for all applicants while the Nord has a dedicated form. Regardless the both seem to have the same instruction as what documentations we need to use.

So my current status is i’ve filled out the Gard Form and am now going down to local FRANCE SERVICES 
 to see if i’ve done it properly before posting it off.

Oh that’s good to know! Thanks for the information. They do seem to be processing my application regardless but we’ll see how it shakes out
 and now I know the next step if they don’t accept it!

The situation is not entirely clear!

The Q&A form that Damaris quotes is dated March 2023. Dated February 2024 is the latest guidance below saying that demands for the EU Family CdS should be made online via ANEF. Given the above dates I would still advise proceeding with the online application until we hear otherwise. I have a feeling that the 2023 document reflected the interim position before applications for EU family members were included in the online process. Before then, applications for this CdS were definitely made at the relevant Préfectures.

Caveat - this being France, I can’t rule out that they’ve switched back to the PrĂ©fecture route, but it would be surprising, and somewhat against the ‘run of play’ in terms of doing everything possible to do with administrative actions online, and is not something that has been announced publicly.

I see your point and I have reread all Eve’s notes. I’ve now taken a leaf out of Eve’s book and have started from scratch again.
Thing is, I was actually getting somewhere when the system froze. I seem to have broken their site. Who knows, maybe the maintenance is fixing the drop-down box for nationalities.

I will try again tomorrow.

Now tempted to pick-up on another suggestion and have a swig of wine, yet may it’s a tad too early :wink:

My husband doesn’t yet have a residency residency permit as a Polish citizen he doesn’t need one.

Hey good to see the drop down box is fixed! I don’t remember this question in this format. I attached our lease agreement which has both of our names on it. They then asked me for more information- our latest rent receipt. I sent this on Monday.

My husband doesn’t have a resident permit either, for the same reason. I attached his Latvian passport copy and also had to send some information related to his self employment. Hope this helps!

For an EU citizen their home nation ID card or passport is generally used in this situation.

Hello everyone! The update is - CDS application approved last Friday, and just waiting for the notification to go and pick it up! Bit relieved as seemed a lil dodgy for a minute there
