Hi has anyone had experience regarding protecting the interests of a handicapped sibling here in France?
My brother is mentally handicapped. He is 45 and my parents are both elderly. They all live with me here in France.
I have discovered recently that in the event of the death of my parents then I will not have authority to deal with my brothers affairs (specifically his inheritance from my parents and any other financial/personal issues) unless I am his designated tutelle. I have googled the tutelle process and it seems relatively straightforward although I understand can take a long time as all the Juge de Tutelles are really busy.
Chatting to someone recently they said there is a simpler solution and that would be for my parents to simply write a "Mandat de Protection Future" ... which basically just says "I, Mr x, nominate my daughter ....... in the event of my death or prior incapcity to act as tutelle for my son, Mr x ....." bla bla and that that would be regarded as a letter of wishes although I understand I would still then need to obtain tutelle status but that it would be an accelerated process.
Anyway, if anyone has any experience of this I would be very interested to hear, otherwise I think I will take myself off to notaire to discuss.
